The Chamber voted on the portfolio law – 06/17/2023 – Elio Gaspari

Sixteen days after the Second Panel of the Federal Supreme Court annulled the conviction of former deputy Eduardo Cunha, the Chamber approved a historic project. With a lightning procedure, a project by Dani Cunha (União Brasil-RJ), daughter of Doctor Eduardo, passed by 252 votes against 163. It criminalizes practices that may be considered discriminatory against public activity and protection extends to their family members.

Among other safeguards, according to the approved project, banks cannot deny credit to some people from any of the three Powers because they have public activity.

The project shields around 10,000 people, parliamentarians, judges, attorneys and leaders of political parties and their families.

Its constitutionality is debatable, but that is a matter for the Supreme Court to decide. In the 19th century, the Brazilian Parliament blocked the application of a law that prohibited the smuggling of slaves. On 21, the Chamber wants to create a special category of citizens based on their activities. There are laws that protect minors, blacks, women and the elderly. They are all generic.

If the bill passes the Senate, the 10,000 will form a caste.

Only five parties voted as a block against the project, PSOL, PC do B, Cidadania, Novo and Rede. Together, they totaled 16 votes.

Upstairs has its mummies

A law from 1831 stated that every enslaved black person who arrived in Brazil was free, as long as he rendered services to the Crown for a certain number of years. The Crown, in turn, outsourced these services, assigning blacks to citizens of “probity and integrity.”

When the black man was put to work, one month of his salary paid the annuity of the concession. A few thousand blacks were privatized.

The two greatest politicians of the Empire, Honório Hermeto Carneiro Leão, Marquis of Paraná, and Luís Alves de Lima e Silva, Duke of Caxias, received dozens of free blacks. Two great journalists of that time (Justiniano José da Rocha and Firmino Rodrigues Silva) also won blacks.

Magistrates, barons, doctors and the people from the palace of D. Pedro 2nd won their lots.
