Temer gives a ‘tragicomic’ response to the ‘coup’, says Cardozo – 01/27/2023 – Mônica Bergamo

The statements by former President Michel Temer (MDB) that the impeachment of Dilma Rousseff (PT), in 2016, followed the Constitution and was a “lucky coup” for the country bothered the former Minister of Justice and former lawyer General of the Union José Eduardo Cardozo.

Defender of the PT at the time of the process that removed her from the Presidency of the Republic, he claims that the emedebist seeks to give a “tragic-comic version” to a “regrettable episode”, which he calls a “coup”.

“The fact that there was a formal impeachment process does not mean that there was not a coup”, says Cardozo to the column. “I even understand former president Michel Temer saying what he says, which I would call ‘illegitimate defense’. He will always defend himself by saying that he did not participate, even when his own interviews show that he recognizes that there was no crime of responsibility.”

This week, Temer manifested himself on social networks to refute a speech by President Luiz Inácio Lula da Silva (PT), who called him a coup plotter during an official trip to Montevideo, Uruguay.

Temer said that the current president insists on keeping “his eyes in the rearview mirror” and trying to “rewrite history through ideological narratives”.

“Contrary to what he said today [na quarta-feira (25)] in an international event, the country was not the victim of any coup. The penalty provided for those who violate the Constitution was actually applied,” wrote the former president.

For Cardozo, however, the impeachment process was an “institutional anything-goe”, and its consequences raised Jair Bolsonaro (PL) to the Presidency and gave rise to episodes such as the coup attacks on January 8 of this year.

“I find it funny that those who deny that there was a coup in 2016 and today criticize or criticize Jair Bolsonaro without realizing that Bolsonarism was generated by the institutional irresponsibility of 2016. society,” says the former minister.

“It amazes me, even today, some people say that there was no coup in the case of Dilma’s impeachment or that one should not look at the past. Why is that? Looking at the past is necessary to avoid the mistakes that can happen in the present and in the future. future. Things have to be said without mincing words: what happened in 2016 was a blow”, he continues.

In the opinion of the former Minister of Justice, the existence of a process that resulted in the deposition of a president is no guarantee that the constitutional rules were strictly followed.

He claims, for example, that there was no act of bad faith on Dilma’s part that would justify the crime of responsibility attributed to her for the practice of tax pedaling.

“Dilma did not commit an illegal act because all previous governments did the same. It was not intentional, and there were manifestations of technical bodies saying that. it says.

Cardozo also claims that the fall of Dilma Rousseff was motivated by lack of support from parliamentarians, which would only be sustained in a parliamentary regime, in which the head of government can fall if he does not have the endorsement of the majority.

“Just take the session [do Congresso, que julgou a então presidente]. It was not for those facts that Dilma was being impeached, but for the work as a whole. Well, the body of work is a political assessment that has no basis in presidentialism to depose a president. The president may lose support from the people and the parliamentary base, but he continues to govern”, says the former minister.

José Eduardo Cardozo still refutes the former minister and current municipal secretary of International Relations of São Paulo, Marta Suplicy, who in an interview with TV Folha stated that the impeachment of 2016 could not be called a coup.

“I didn’t think it was a coup, at all. It went through all legal channels, it was absolutely within the Constitution”, said Marta on Thursday (26), preaching that it was not time to “look at spilled milk” in the face of problems more urgent.

“I strongly disagree,” says Cardozo. “Of course we must look to the past. Why study history? To understand the present”, says the former minister.
