TCU Public Prosecutor’s Office requests balance of accusations – 03/06/2023 – Mônica Bergamo

The Public Ministry of Accounts with the TCU (Tribunal de Contas da União) sent a representation asking the court to calculate the damage caused to the treasury by award-winning delations entered into by the Public Ministry —and whether they can be considered legal.

The request was made by the deputy attorney general Lucas Rocha Furtado with the TCU this Monday (6). The request cites an interview by former governor Sergio Cabral, given to the Metrópoles portal, in which he apologizes to the minister of the Federal Supreme Court (STF) Dias Toffoli and the president of the Federal Audit Court (TCU), Bruno Dantas, for accusations made in his award-winning denunciation in 2019.

Cabral accused the Supreme Court magistrate and Bruno Dantas of receiving bribes. In May 2021, the plea agreement with the Federal Police was annulled by the STF.

“I want to apologize to Minister Toffoli. I want to apologize. I got angry with the Judiciary, I thought the whole world was conspiring against me, and I distorted a story. I want to apologize to Minister Dias Toffoli, who always treated me with great distinction , who never asked me for anything wrong,” Cabral told Metrópoles. He also apologized to Bruno Dantas.

The sub-attorney asks the TCU to assess “the cost to the treasury related to the realization of award-winning collaboration agreements […] especially in the face of evidence of damage to the treasury arising from agreements that were subsequently not ratified by the Judiciary”.

“Not infrequently, homologations to agreements were rejected by the Judiciary Power or collaborators recanted their proposals. Although legal –from a legal point of view—, I wonder how the lives of those ‘accused’ who were cited in dubious accusations are living” , says Lucas Rocha Furtado.

And he continues: “In this sense, it should be noted that simple apologies for accusations that managed to obtain wide repercussions do not serve to recompose the lives of the ‘accused’ who had their lives destroyed by false accusations”.

The sub-prosecutor still makes a self-criticism and says that, despite “in other times” having defended this type of agreement, today he understands “that it is a clear disrespect to the principle of human dignity and the democratic rule of law”.

“How can the State encourage people to hand over their partners to obtain advantages? I’m not just referring to personal advantages for whistleblowers, but the State’s own undue advantage to use people for this purpose”, he questions.

Lucas Rocha Furtado says that Sergio Cabral’s interview would show how the award-winning accusations “have only served, inadvertently, to accuse third parties in order to affect their lives, especially image and honor, in clear disrespect to objective good faith and administrative morality” .

Last week, Judge Eduardo Appio, from the 13th Federal Court of Curitiba, revoked the latest restrictions on the circulation of former governor Sérgio Cabral in the country. He can leave the house at night, as well as on weekends and holidays.

Appio’s decision was taken in order to comply with the prohibitions imposed by the TRF-2 (Federal Regional Court of the 2nd Region) and by the Court of Justice of Rio de Janeiro.
