TCU fines mayor of Mazagão for failing to report on federal funds – News of Brazil

The Second Chamber of the Federal Court of Accounts (TCU) condemned João “Dudão” da Silva Costa, mayor of Mazagão, to pay a fine of BRL 30,000 for failing to account for resources received in the National School Feeding Program (Pnae/FNDE 2016), showing serious contempt for public affairs. The mayor had the accounts judged irregular.
The ministers’ decision was taken in the trial of the review appeal filed by former mayor Giodilson Pinheiro Borges against a judgment reported by minister Ana Arraes, which had condemned him to return more than R$ 320,000 to public coffers, in addition to a fine in the amount of BRL 186 thousand.
Dilson claimed that he was no longer in office as mayor (he was in Brasília as a parliamentary advisor) when he became aware that Mayor João da Silva Costa had not rendered accounts, although all documentation proving the regular use of resources was in the city hall. Gilson Borges’ mandate ended on December 31, 2016, and the deadline for rendering accounts with the FNDE ended on August 21, 2017.
Dilson stated that, despite the documentation being in the city hall, the mayor Joao da Silva Costa failed to fulfill the obligation imposed on him, in addition to offering undue legal representation against him.
According to the rapporteur, minister Benjamin Zymler, Mayor Dudão, unlike rendering accounts, even in possession of all the documentation (processes for the respective rendering of accounts of the PNAE Program), filed a representation with the (Attorney General of the Republic) Federal Public Ministry for administrative impropriety and for crimes in disfavor by Dilson Borges, arguing lack of documentation.
“Not even the processes – from June to November/2016 – were presented to the FNDE by the current manager of the municipality. In fact, there is an express confession, not only of his complete negligence, but of the qualified bad faith of the current manager (João Costa) of the municipality”recorded the rapporteur.
For Zymler, the criminal representation of Mayor João Costa is a false premise that gave rise to and provided support to the previous judgment that condemned Dilson Borges, being a disreputable document elided by affirmation of the municipal secretary of Education of Mazagão, based on falsehoods.
