TCU condemns former mayor of Santana to return almost BRL 300,000 to National Treasury coffers – News of Brazil

The ministers of the 1st Panel of the Federal Court of Accounts (TCU) condemned José Antônio Nogueira de Sousa (PT), former mayor of the municipality of Santana, for the payment of R$ 299 thousand, plus payment of a fine of R$ 60 thousand, amounts that must be deposited in the National Treasury coffers with the addition of default interest calculated from December 23, 2008.
The condemnation of the former mayor is the result of a special accounting instituted by the Ministry of Tourism, due to the lack of proof of the regular application of the resources passed on to the municipality of Santana through Agreement 01320/2008, whose object was to support the realization of the event entitled “Project Santana, City of Lights”.
The ministers excluded from the procedural relationship the singer and composer Marcelo Dias and the Association of Musicians Composers of Amapá (Amcap), and judged the accounts of former mayor Antônio Nogueira, considered in default, to be irregular. The defense allegations presented by Marcelo Dias, then president of the association, were accepted by the TCU ministers. The rapporteur of the process was the deputy minister Augusto Sherman Cavalcanti.
In the Judgment (4125/2023 – TCU – 1st Chamber) of the session, held on May 30, the ministers authorized the judicial collection of debts if the notifications were not heeded; and determined to send the decision to those responsible and to the Ministry of Tourism, for notification; as well as to the Public Prosecutor’s Office in the state of Amapá for the adoption of the measures it deems appropriate.
