Tacla Duran awaits communication between courts to come to Brazil

A hearing in the Chamber of Deputies that would have the presence of Rodrigo Tacla Duran, a former lawyer for the construction company Odebrecht, was canceled last Monday (19), because he is also investigated for the crime in Spain, where he is currently. Although the Federal Supreme Court (STF) granted a safe-conduct that would make his trip to Brazil possible, there was no time for the Justices of the two countries to communicate.

Technically, there was not enough time to issue a document called a rogatory letter, which would allow him to come to Brazil to participate in the meeting of the Administration and Public Service Commission in the Chamber. The information was confirmed by the advisory of Deputy Rogério Correia (PT-MG), author of the request to hear Tacla Duran.

The former Odebrecht lawyer lives in Spain and is being investigated for money laundering. He was one of the operators of the corruption scheme involving the construction company discovered by the Lava Jato operation. He would participate in the hearing in the Chamber to explain the allegations he made, for which he would have been extorted by members of Lava Jato.

The letter rogatory works as a “tool” for communication between justices in different countries, and serves to communicate compliance with procedural steps, such as subpoenas, testimonies, collection of materials and others.

Last week, Minister Dias Toffoli, of the Federal Supreme Court, annulled Lava Jato evidence against the lawyer, which allows him to be released from similar processes that he also responds to in the European country, for money laundering, and can return to Brazil .

The STF minister considered that the actions being processed by the 13th Federal Court of Curitiba used evidence obtained in the Odebrecht leniency agreement, and considered “useless” by the Court.

“In view of the foregoing, I grant the request contained in this petition and extend the effects of the decision handed down in Complaint No. 43.007/DF to declare the unworthiness, as for the applicant, of the evidence obtained from the Drousyse My Web Day B systems , used in the Leniency Agreement entered into by Odebrecht,” said Toffoli.

In another decision, Dias Toffoli granted safe conduct to Tacla Duran, in habeas corpus presented by the House Committee, so that he could participate in the meeting.

Deputy Rogério Correia said in an interview prior to People’s Gazette that the purpose of the commission is to hear the lawyer’s version of allegations that he had been the victim of extortion in order not to be arrested in Brazil.

Tacla Duran told the then judge of the 13th Court of Curitiba, Eduardo Appio, that he paid bribes to a lawyer partner of Deputy Rosângela Moro (União-PR), wife of the senator and then Lava Jato judge, Sergio Moro. He also accused the then deputy and former Lava Jato coordinator, Deltan Dallagnol. Both Moro and Dallagnol deny the accusations, and say they are nothing but lies.

Previously, this same accusation had already been rejected by the Federal Public Ministry (MPF), due to lack of evidence, which also led the body to reject a collaboration agreement with the lawyer.

The new date for Tacla Duran’s visit will be negotiated jointly by the Chamber’s Administration Commission, the Ministry of Justice, the Federal Supreme Court and the lawyer, with the approval of the Spanish justice system.
