The minister of the Federal Supreme Court (STF) Edson Fachin declared extinct this Tuesday (16) the custodial sentences imposed on former deputy Paulo Maluf. The minister considered that, as he was over 70 years old and had served more than a third of his sentence, Maluf met the requirements for granting a Christmas pardon provided for in Decree 11.302/2022, edited by former President Jair Bolsonaro (PL).

The pardon covers only custodial sentences, therefore, the other effects of the conviction are still valid. The defense of the former parliamentarian requested the extinction of sentences on two other occasions based on the decree of Christmas pardon. In previous appeals, in 2019 and 2021, the rapporteur denied the request for lack of sufficient requirements.

“According to Fachin, the penalty in both criminal actions adds up to 10 years, 6 months and 10 days. As he is 92 years old and has served more than half of that total, Maluf falls within the rules laid down in the presidential decree. The minister also highlighted that the Attorney General’s Office (PGR) and the Penitentiary Council of São Paulo presented opinions favorable to the granting of the benefit”, said the Court, in a note.
