STJ puts Robinho’s case back on the trial agenda

The Special Court of the Superior Court of Justice (STJ) scheduled for August 2nd the analysis of Robinho’s appeal against the monocratic decision of Minister Francisco Falcão. The magistrate, rapporteur of the case, denied the defense’s request for the Italian government to send the full and translated copy of the process that sentenced the player to nine years in prison for the rape of a young Albanian woman at the Sio Café nightclub, in Milan, in 2013.
The trial was suspended for 60 days, with the possibility of extending it to 90, after Justice João Otávio de Noronha requested a review of the case file.
The case returned to the STJ’s agenda one day after the release of unpublished audio of Robinho’s conversations with friends, used by the Italian Justice in the player’s conviction, by the podcast “Os Grampos de Robinho”, on the UOL portal. The former striker for Santos and for the Brazilian national team handed over his passport and is banned from leaving Brazil, but he remains free due to the fact that the country does not extradite Brazilians. He was playing for Milan at the time the crime took place.
The president of the STJ, Maria Thereza Rocha de Assis, received this Wednesday a request signed by the president of the Constitution and Justice Commission (CCJ) of Alesp, Thiago Auricchio (PL), asking for speed in the analysis of the case so that the player complies worth it in Brazil.
Robinho was ultimately convicted in February 2022. Ricardo Falco, a friend of the player, was also convicted of participating in the crime. The Italian Justice asked for Robinho’s extradition in September of the same year, but with the refusal of the Brazilian government, it was asked in February of this year for the player’s sentence to be executed in Brazil.
The execution of a foreign judgment is provided for in the Federal Constitution and is supported by the Immigration Law. The STJ proceeded with the process at the end of February. The Attorney General’s Office considers that there are “no restrictions on the transfer of the execution of the sentence imposed on foreign-born Brazilians”.
