STF wants speed without running over in actions against Bolsonaro – 01/25/2023 – Panel

Ministers of the STF (Federal Supreme Court) assess that analyzing the actions against former president Jair Bolsonaro (PL) at the TSE (Superior Electoral Court) can quickly contribute to giving more legitimacy to any decisions, but they fear that the rush will override the rite and generate criticism.

One of the court holders privately states that putting the actions on the agenda until May would make the trial take place with the same composition that followed the electoral period in 2022. A series of precautionary measures were taken during the electoral period, for example.

In May, Minister Ricardo Lewandowski retires, and should be replaced by Kassio Nunes Marques, who was appointed by Bolsonaro and is seen as more favorable to the former president.

On the other hand, there is a concern in the court not to trample due legal process. A minister fears that the court will be criticized for quorum manipulation by guiding action before the change of ministers.

Other processes involving presidents of the Republic took longer to be analyzed. The action that called for the impeachment of the ticket of Dilma Rousseff (PT) and Michel Temer (MDB), for example, only had a trial concluded more than two and a half years after the 2014 election.

The perception is that the legitimacy of the processes involving Bolsonaro, who had 58 million votes, will be given by a well-founded and structured rite, regardless of the date. Who reports the actions is the TSE corregidor, Minister Benedito Gonçalves.

THE Sheet revealed on Sunday (22) that members of the TSE want to speed up judgments and seek to analyze, by the middle of the year, processes that may make the former chief executive ineligible – that is, prohibited from running for elections.
