STF releases SP City Hall urban projects in Pinheiros and Jurubatuba – 03/30/2023 – Panel

The Minister of the Federal Supreme Court (STF), Rosa Weber, overturned this Thursday (30) injunctions that suspended the São Paulo City Hall bills referring to the Urban Intervention Projects (PIUs) Arco Jurubatuba and Arco Pinheiros.
With the decision, the projects may undergo a second vote at the São Paulo City Council.
Proposed by the Executive branch, the PIUs or urban operations are sets of incentives and rules for better use of areas, in order to stimulate occupation in the regions. The plans require counterparts from the real estate market, with the potential to raise billions for urban improvement works.
The Public Prosecutor’s Office and the Public Defender’s Office of São Paulo filed public lawsuits arguing that the projects should have environmental impact studies to be voted on by the São Paulo Legislature and were accepted by the state Court of Justice.
In her decision, the minister claims to see prejudice to the exercise of the function of the Legislative in the injunctions that suspended the processing of bills. According to Rosa Weber, councilors have the fundamental role of legislating, which includes the debate and deliberation of bills, which can even result in the rejection of proposals.
On March 15, Ricardo Nunes (MDB), mayor of São Paulo, had an audience with Weber and other STF ministers in Brasília.
One of the bets of the emedebista in his campaign for re-election in 2024 are urban projects around the city. On March 20, the city hall sent the project to the City Council for revision of the Master Plan.
