STF releases R$16.7 million more per month for judges – 12/25/2023 – Panel SA

The Federal Court began to receive R$ 16.7 million more in its monthly paycheck from December of this year with the Federal Supreme Court’s refusal of an appeal from the Union, against payment.

The decision was published on Wednesday (20). The AGU appealed at 6pm on the same day and Minister Barroso, two hours later, denied the request, replacing the case’s rapporteur, Minister Dias Toffoli.

In practice, Barroso allowed the payment to be made until the Supreme Court’s activities resumed in February, when Toffoli will decide on the appeal.

The values ​​refer to an additional payment for length of service for federal magistrates who joined before 2006.

A resolution by the CNJ (National Council of Justice) had already incorporated this amount into the paychecks of the federal judiciary as a subsidy.

However, recently, the state court, taking advantage of a STF decision in a similar case involving another category of civil servants, filed a lawsuit requesting the incorporation of the additional fee — which was granted.

In light of this, the CJF (Federal Council of Justice) began paying funds to federal judges.

The TCU opened proceedings, ordering the suspension on the grounds that this amount had already been paid in accordance with a CNJ (National Council of Justice) ordinance from 2006.

Ajufe (Association of Federal Judges) went to the Supreme Court against the TCU and obtained a favorable decision.

The AGU (Attorney General’s Office) then asked the STF to immediately suspend the payment. In the defense, the lawyers claim that the TCU exercised its administrative role by opposing an expense that was already incorporated into the income paid to the federal judiciary.

Independence

Ajufe defends the independence of the Judiciary, as well as the competence of the National Justice Council and the Federal Justice Council to determine the budget of the Federal Justice.

“The payments are constitutional and are included in the Federal Court’s budget without the need for a budget increase,” he said in a note. “The Federal Supreme Court, completely correctly, recognized the incompetence of the Federal Audit Court to suspend or interrupt payments approved by the competent bodies.”
