STF must change privileged forum as a strategy to catch Bolsonaro

In today’s program, Deltan Dallagnol and lawyers Fabiana Barroso and Emerson Grigolette comment on the STF judgment that should allow the expansion of the privileged forum beyond the period of mandate of the authorities.

Although Minister Luís Roberto Barroso requested a review and the process was halted last week, five ministers have already spoken out in favor of the change, which aims to alter the current rules limiting trials in higher courts to crimes allegedly committed during the period mandates and related to the positions held.

As a result, processes involving cases outside this framework and that would go to the first instance are now judged by higher courts, as is the case with actions involving former president Jair Bolsonaro.

And, they also analyze the trial of senator Sergio Moro at the Regional Electoral Court of Paraná (TRE-PR). The senator and former Lava Jato judge is accused of abuse of economic power in actions proposed by the PL and the PT-PV-PCdoB Federation, which argue that Moro exceeded electoral spending during the pre-campaign, between November 2021 and March 2022, a period in which he joined Podemos and assumed the role of pre-candidate for the Presidency of the Republic. The trial may culminate in the revocation of the mandate.
