The STF (Federal Supreme Court) upheld a criminal complaint filed by federal deputy Tabata Amaral (PSB-SP) against Eduardo Bolsonaro (PL-SP), her Chamber colleague, for defamation.
What happened
The determination of the STF took place by 6 votes to 5 in the virtual plenary. The ministers were considering an appeal filed by Tabata against a decision in which Minister Dias Toffoli had filed the action filed by the deputy in 2021.
By rejecting the criminal complaint, Toffoli said that the STF consolidated the understanding that the deputy was protected by the right to parliamentary immunity. Ricardo Lewandowski, André Mendonça, Luiz Fux and Kassio Nunes Marques accompanied this demonstration.
However, Alexandre de Moraes, Edson Fachin, Cármen Lúcia, Roberto Barroso, Gilmar Mendes and Rosa Weber voted in favor of Tabata. In their assessment, the statements by the son of Jair Bolsonaro (PL) constitute offenses that violate the limits of political criticism.
The case involves a publication on a social network in which the parliamentarian says that the congresswoman would have prepared a bill “with the purpose of illicitly benefiting third parties”. The bill in question deals with the distribution of sanitary pads in public spaces.
According to Eduardo, the proposition sought to meet the interests of Jorge Paulo Lemann. The businessman was appointed by the deputy as a mentor and sponsor of the parliamentarian and one of the owners of Procter & Gamble, a manufacturer of hygiene products.
