STF forms majority to make defendants over 70 accused of 1/8 – 06/09/2023 – Power

The STF (Federal Supreme Court) formed a majority this Friday (9) to make defendants over 70 denounced by the PGR (Attorney General of the Republic) after the coup acts of January 8.

This is the seventh round of judgments that deal with those investigated to participate directly or encourage attacks on the headquarters of the three Powers.

So far, the Supreme Court has turned 1,175 suspected of involvement in the attacks into defendants, with the forecast that the processes, with eventual conviction or acquittal of the accused, will be processed in the court itself.

As the 70 accused in the virtual plenary session that ends this Friday must become defendants, the number will reach 1,245. There are still 145 cases to be analyzed.

In the round involving 70 accused, the rapporteur, Alexandre de Moraes, and ministers Luiz Fux, Edson Fachin, Luís Roberto Barroso, Gilmar Mendes, Dias Toffoli and Rosa Weber have already voted to accept the accusations. Minister Cármen Lúcia had not yet voted.

Ministers Kassio Nunes Marques and André Mendonça, who were appointed to the Supreme Court by former President Jair Bolsonaro (PL), voted in most cases against receiving the complaints and turning the accused into defendants.

This rejection would be in relation to those accused of inciting the attacks, especially people who camped in front of the Army Headquarters in demonstrations that supported the coup d’état.

However, in six of the 70 cases, involving people directly linked to the attacks on public buildings, the two ministers appointed by Bolsonaro defended that the competence to analyze the cases does not belong to the Supreme Court, but if defeated in this regard, they agree to receive the complaints. .

In all, 1,390 people were denounced by the PGR for involvement in the attacks. In statements about the case, the Attorney General’s Office stated that there was a set of evidence to support the accusation, such as images, messages and testimonies.
