The second panel of the Federal Supreme Court (STF) determined that the Justice of the State of Rio de Janeiro judge again a Psol action against councilor Carlos Bolsonaro (Republicanos-RJ) that linked the party and former federal deputy Jean Willys to the attack against ex-president Jair Bolsonaro (PL), who was stabbed in September 2018. The trial was held on the 26th and the decision was published in the late afternoon of Monday (29).

The magistrates maintained a decision by Minister Gilmar Mendes that annulled the rejection of the party’s criminal complaint by the State Justice. Mendes said that there was an omission in relation to one aspect of the process, that only part of the content that the councilman published on social networks against the party was observed, and not the context of the series of messages.

For the minister, parliamentary immunity cannot be claimed in this case either. According to Gilmar Mendes, it is possible to establish objective limits for freedom of expression in order to inhibit the practice of criminal offenses and attacks against the honor of third parties.
