STF annuls Bolsonaro’s decree that suspended Silveira’s conviction

Brasilia DF) – The Federal Supreme Court (STF) overturned today (10) the validity of the constitutional pardon granted by then-president Jair Bolsonaro to former federal deputy Daniel Silveira.

By votes 8 votes to 2, the Court understood that the decree is unconstitutional for Bolsonaro’s misuse of purpose to benefit Silveira.

With the decision, the conviction of the politician by the STF to eight years and nine months in prison for the crimes of trying to prevent the free exercise of powers and coercion in the course of the process to which he responds for attacks on the Court is reinstated.

The former deputy has been in prison since February this year for breaking house arrest rules and making new attacks on the Supreme Court.

Last year, Bolsonaro signed a decree granting constitutional grace to the sentence of Silveira, a supporter of the then president and a member of his base in the Chamber of Deputies.

The decree was published on April 21, the day after the parliamentarian was condemned by the Supreme Court.

Wishes

At the trial, the vote by the President of the Court and rapporteur for the cases, Minister Rosa Weber, prevailed to annul the benefit.

Ministers Alexandre de Moraes, Edson Fachin, Luís Roberto Barroso, Dias Toffoli, Cármen Lúcia, Luiz Fux and Gilmar Mendes followed the understanding.

Ministers André Mendonça and Nunes Marques voted to validate the pardon. For them, the Constitution granted the President of the Republic the power to grant constitutional grace to convicts, a measure that cannot be reviewed by the Judiciary.
