SP judge accuses Lula of ‘relativizing’ thefts in decision – 07/24/2023 – Mônica Bergamo

A judge from the district of Jales, in the interior of São Paulo, made use of the ten biblical commandments and suggested that President Luiz Inácio Lula da Silva (PT) minimizes and even contributes to the increase in cell phone theft by decreeing the preventive detention of a man who allegedly committed the practice.

The defendant frequented a snack bar in a town close to Jales when he was arrested red-handed, accused by the owner of the establishment of stealing a cell phone — which, at that moment, was being used by her daughters. According to reports, the man was drunk.

The case took place last week and was judged by magistrate José Gilberto Alves Braga Júnior on Saturday (22), during the judicial duty. In his decision, the judge states that the only alternative is to keep the accused in prison, since other measures would not be “appropriate and sufficient” to prevent the commission of new crimes.

“The elements collected so far reveal that the person charged committed the crime of aggravated theft”, decided the magistrate, in a custody hearing. For him, the collected evidence would prove that the man is “capable of endangering society” if he returns to social life.

“Perhaps the theft of a cell phone has become a common practice in the capital, not least because this conduct is relativized by those who hold the current position of President of the Republic, but for those who live in this region, crime is a crime, and the conduct of someone who subtracts what belongs to another cannot be considered normal and acceptable”, says judge José Gilberto Alves Braga Júnior.

After the case was revealed by the column, the Advocacy General of the Union (AGU), led by Jorge Messias, decided to file a complaint with the National Council of Justice (CNJ) against the magistrate.

The mention of Lula made by the judge refers to false news disseminated in the 2022 elections. The then president, Jair Bolsonaro (PL), even reproduced it during the national convention of his party. “That same guy [Lula] that defends the theft of cell phones as a right of the criminal to steal to have a beer”, said the then representative.

The petista, however, never defended the practice. The statement is based on a manipulated video that has been circulating on Bolsonarist networks for some years. In it, two distinct speeches by Lula were edited with the aim of changing the meaning of the statement.

In addition to mentioning the current president, the judge of the district of Jales also cited a publication that dealt with the ten biblical commandments.

“The ten commandments, carved on the Tables of Laws, form one of the most well-known biblical passages. In addition to rules for life, they bring two crucial crimes for humanity: you shall not kill (homicide); you shall not steal (theft),” says the quote, reproduced in the custody hearing term.

According to Braga Júnior, theft, even if practiced in an inland city, inhabited by “good and honest people”, is an act contrary to the legal system and not acceptable, “although violence and a serious threat are absent”.

According to the file, the public defender Mateus Moro, who represents the man before the Justice, maintained that he is a primary defendant and deserves the granting of provisional release, with the application of precautionary measures other than imprisonment.

The defender also requested that the custody hearing be invalidated, since it was held virtually. The distance modality, adopted during the Covid-19 pandemic, was revoked by the CNJ (National Council of Justice) in a resolution at the end of last year. The judge, however, denied the request.
