SP City Hall withdraws R$ 20 million public notice after Tabata – 05/21/2023 – Mônica Bergamo

The City of São Paulo backed down and decided to revoke a public notice worth R$ 20 million that would boost the communication services of the municipal management. The measure comes after the contest was questioned by federal deputy Tabata Amaral (PSB-SP), who obtained the suspension of its proceedings in court.

An opinion presented by the legal advisory of the Municipal Government Secretariat recognized that the public notice was published “without prior legal opinion” and that, after in-depth analysis, it was possible to conclude that the event would be unfeasible in the way it was proposed.

The agency also stated that the bidding procedure was initiated “due to the significant demand for services related to the press”, but that new studies will be prepared “aimed at adapting the object to be contracted”.

A possible rival of the mayor of São Paulo, Ricardo Nunes (MDB), in the 2024 municipal elections, Tabata Amaral says he will continue to question other municipal management expenses.

“Stopping this first edict is just the beginning. The mayor needs to justify to the population why he wants to spend so much on advertising, on the eve of the elections, while there is a lack of investment in disaster prevention, in improving our buses, in more dignified shelters for the population in street situation”, says the parliamentarian.

The PSB deputy is questioning in court an edict that provides for the investment of R$ 80 million in advertising services. Tabata’s demand has already obtained a favorable opinion from the São Paulo Public Ministry, but in January of this year it was rejected by the 4th Public Treasury Court of the São Paulo Court of Justice.

At the time, judge Sergio Serrano Nunes Filho decided that there were not enough reasons given to “remove the presumption of regularity of administrative conduct”, since the city hall may come to prove the need to open a public notice for competition.
