A bill presented this Thursday (90) by Senator Magno Malta (PL/ES) seeks to typify as a crime the submission of a child or adolescent to surgical intervention or transsexualization treatment.

PL 441/2023 provides for imprisonment of 4 to 12 years and a fine in case of submitting minors to sex reassignment surgery. “Non-surgical” means are also contemplated in the proposal – if the “child or adolescent is subjected to hormone therapy, educational teaching, psychological treatment or any other non-surgical means related to transsexualization”, the penalty can be imprisonment from 1 to 4 years and fine.

According to the senator, the case that occurred at the Hospital das Clínicas of the University of São Paulo, in which children would be having puberty blocked and young people receiving hormones from the opposite sex, represents a “serious violation of the rights to health, physical, mental, moral and social development”. spiritual life and the dignity of children and adolescents”.

“In this sense, it is necessary to provide for legal instruments that prevent such conduct, in order to prevent children and adolescents, who are in an evident stage of formation, from being subjected to treatments with unpredictable and, often, definitive effects on their lives”, he says. the senator. He also highlights the possible cases of psychic disorders, regrets and searches for reparations in adults who have undergone sex reassignment procedures.
