Senate files PEC against abortion definitively – 01/04/2023 – Mônica Bergamo

The Federal Senate definitively archived the so-called “PEC da Vida”. Proposed by Senator Magno Malta (PL-ES) in 2015, the text sought to restrict legal abortion in the country and was unarchived in the first months of the government of Jair Bolsonaro (PL).

As the agenda was already being processed for two legislatures and did not gather the support of a third of the House’s parliamentarians to proceed, its destination was permanently in the drawer. The decision is included in the system of legislative activities of the Senate.

In 2019, the Proposed Amendment to the Constitution was considered by the House Committee on Constitution, Justice and Citizenship. The matter, however, was removed from the agenda after its rapporteur, the then Senator Judge Selma Arruda, defended the maintenance of cases of termination of pregnancy currently contemplated by law.

The caveat surprised supporters of the “PEC da Vida”, who called for a more severe law. That same year, Selma Arruda had her mandate revoked. Since then, there has been no designation of a new rapporteur, and the proposal has stalled.

The PEC advocated adding to Article 5 of the Constitution that the right to life is guaranteed “from conception”, in line with what anti-abortion groups defend.

“The omission in the constitutional text on the origin of life has allowed a serious attack on the dignity of the human person who is deprived of legal protection in the gestation phase, precisely the phase in which the human being is most dependent on protection in all aspects” , stated Magno Malta in his justification for the existence of the PEC.
