São Paulo PM tries to shield impunity in massacres with medals – 01/11/2024 – Frederico Vasconcelos

Court of Justice does not provide services to the police. Judges from São Paulo have been receiving medals for years for “services rendered to enhancing the image of the Military Police”.

The citizen can assume a non-existent subordination. Excessive honors can suggest to the corporation the mistaken idea that the troop’s excesses are approved by the court.

On October 16, Governor Tarcísio de Freitas decorated former president Jair Bolsonaro with a Rota medal (Rondas Ostensivas Tobias de Aguiar).

Bolsonaro granted a Christmas pardon to the perpetrators of the Carandiru massacre. The governor and members of the corporation also received the decoration.

“The encouragement of police violence was one of the hallmarks of the Bolsonaro government. The pardon granted to those responsible for one of the most serious massacres in the country’s history is the portrait of this project of institutionalizing the right to kill lives with impunity, especially black lives”, they stated criminal law professors Ademar Borges and Pierpaolo Cruz Bottini, at Sheet.

In 2013, judge Ivan Sartori, rapporteur of the Carandiru case at TJ-SP, was decorated by the PM’s riot police for “relevant services rendered […] to elevate the name of the Military Police”.

The former president of TJ-SP stated: “This is the fifth medal I have received from the PM and it makes me very proud.” Three years later, Sartori voted to acquit the police officers, without the need for a new jury.

At the end of 2022, the president of TJ-SP, Ricardo Mair Anafe, received three medals from the Military Police. He was awarded a Rota medal.

Anafe overturned an injunction that forced the use of body cameras by the PM in all Escudo operations, launched on the coast, after the death of a Rota soldier. The decision was endorsed by the Special Body of the TJ-SP.

With signs of slaughter, the operation was considered the second most lethal in the history of the Military Police.

“The promise made by the elected governor of São Paulo to order that the cameras installed on military police uniforms be removed is cause for concern. (…) Such removal of cameras, if implemented, will be understood by sectors of the police as true authorization to kill , outside the legal hypotheses”, wrote Luiz Antonio Guimarães Marrey, former attorney general of Justice.

“I was the judge reporting on the Carandiru case.” This was the motto of Sartori’s frustrated election campaign for the Federal Chamber. He came in 860th place.

The former president of the TJ-SP said that “the press made a clear defense of the bandits who rebelled. Therefore, our action was necessary so that the police officers could be exonerated.”

The brutal police intervention in the former São Paulo Detention House in 1992 resulted in the deaths of 111 prisoners. Judge Edison Brandão, from TJ-SP, said that “the 112th victim of the massacre was the Military Police”.

In November 2022, Brandão requested a review and postponed the Carandiru process. In 2017, he received a medal from the PM.

Under the title “Judges try to bury the Carandiru massacre“, we published on the blog that “the postponement [com o pedido de vista] fueled speculation that the Carandiru defendants could be pardoned by Bolsonaro at Christmas.”

The president of Apamagis (São Paulo Association of Magistrates), Vanessa Mateus, contested. She stated in a note that “the text does a disservice by wrongly speculating about the functioning of São Paulo’s justice system, promoting, once again, distrust in the Judiciary.”

“The statements are intended solely to tarnish the honor of an excellent judge,” he said.

A month later, the defendants were pardoned.

Last December, journalist Mônica Bergamo reported on Sheet that the new president of Apamagis, Thiago Massad, was honored at a lunch with secretary Derrite, the general delegate of the Civil Police, Artur José Dian, judges and lawyers.

Former Secretary of Justice Fernando José da Costa, host, said that the lunch was “a catalyst for increasingly productive and harmonious inter-power relations”.
