Ruralists get support for the urgency of the time frame – 05/16/2023 – Panel

With the consent of the mayor, Arthur Lira (PP-AL), federal deputies Fábio Garcia (União-MT) and Zé do Trovão (PL-SC) obtained 262 signatures to guide an urgent request for the bill of timeframe.

Object of disagreements in the House, the proposal establishes the 1988 Constitution as a framework for the demarcation of indigenous lands in Brazil. Areas occupied after that could not be designated for the exclusive use of the original peoples.

If approved, the urgency request takes the PL 490/2007 straight to the plenary of the Chamber, suppressing the processing in the thematic commissions already in the same session. There is still no date for voting.

Such as Sheet showed, Lira consented to the movement of the Agricultural Parliamentary Front, known as the ruralist group. The objective would be to empty the judgment of the subject in the STF (Federal Supreme Court). The President of the Court, Rosa Weber, scheduled the vote for June 7.

“Faced with the uncertainty that exists about the judgment in the Federal Supreme Court, there is a need for an urgent vote on this issue to guarantee legal certainty to all rural producers and private landowners in that country”, says Fabio Garcia.

“The indigenous population does not need more land. Rather, it needs to be able to extract adequate living conditions and quality of life from the areas owned by them, with the riches they have there,” he argues.

The judgment of the STF is given specifically on one case, that of the Indigenous Land Ibirama-Laklanõ (in Santa Catarina), of the Xokleng people, but it has a “general repercussion” character —when a court decision serves as a reference for everyone’s understanding cases on the subject.
