Rosa Weber goes to prison in PE convicted of violations – 04/04/2023 – Mônica Bergamo

The president of the STF (Federal Supreme Court) and the CNJ (National Council of Justice), Rosa Weber, visits this Tuesday (4) the Curado Prison Complex, in Recife, which has already been the subject of a decision by the Inter-American Court of Human Rights (CIDH) for perpetuating serious human rights violations.

The minister’s trip to Pernambuco is part of her attempt to accelerate the necessary transformations in the state’s prison system. Weber will discuss the topic with local managers, including Governor Raquel Lyra (PSDB). During the meetings, inspection reports made by the CNJ in 2022 will be presented.

Last year, an injunction granted by STF Minister Edson Fachin recognized that non-compliance with an IACHR decision for the Curado Complex has prolonged the range of violations identified at the site.

In an inspection carried out in 2016, the international court confirmed allegations that had been made by human rights defenders. These included cases of torture and sexual abuse, precarious access to health and food, circulation of firearms among detainees and overcrowding.

The visit marked the first time that the international court had visited a prison on the American continent. At least 32 homicides have been documented in Complexo do Curado.

In 2018, the Inter-American Court of Human Rights determined that the days of sentence served in prison facilities should be doubled, as a form of compensation for the degrading conditions to which detainees are subjected.

Differing decisions given by criminal enforcement judges, however, led to the initiation of a procedure by the Court of Justice of Pernambuco, which must seek a consensus. In June of last year, all cases that discuss the calculation of double the sentence were suspended pending the judgment of the issue.

The case of the Complexo Prisional do Curado reached the Inter-American Court after a petition filed by Justiça Global with the organizations Ecumenical Service of Militancy in Prisons, International Human Rights Clinic of Harvard University, Pastoral Carcerária de Pernambuco and Pastoral Carcerária Nacional.
