Roberto Cidade establishes ‘Statute of the Person with Obesity’ for access to basic rights

Manaus (AM) — As a way to avoid embarrassment and promote the guarantee of rights, state deputy Roberto Cidade (UB), president of the Legislative Assembly of Amazonas (Aleam), presented Bill No. 779/2023, which establishes the Statute of the Person with Obesity. The measure is intended to promote inclusion, rights, health protection, adequate treatment, social assistance and insertion in the labor market.

“It is the duty of the Government, of society, of the family and of the community to assure people with obesity their right to life, health, education, culture, leisure, work, citizenship, dignity. The Statute aims to ensure that anyone with obesity is not neglected, discriminated against, suffers from prejudice or is violated in their rights. It is important that we move forward with this project.”

According to the Statute of the Person with Obesity, comprehensive care is ensured for the person with obesity, through the Unified Health System (SUS), guaranteeing universal and equal access, in an articulated and continuous set of actions and services, for the prevention, promotion, protection and recovery of health, including special attention to diseases that commonly affect people with obesity.

In its Sole Paragraph, it is established that the offices, clinics, outpatient clinics and hospitals will guarantee accessibility and priority of service to people with obesity who have reduced mobility. The statute also foresees specificities related to the right to Education, Sport and Leisure; as well as access to intercity passenger transport in special seats and access to the job market.

The Statute of the Person with Obesity also establishes care measures in the Assistance and Guarantee of Rights to the person with obesity and their family, among them guarantee of safety, qualification and rehabilitation, development and maintenance of autonomy and family and community coexistence .

With regard to assistance to people with obesity in health units in the State of Amazonas, the Statute establishes that public and private hospitals and emergency care units are obliged to provide: access ramps; proper size apron for obese person; special scale; specific and reinforced wheelchairs; stretchers suitable for transporting obese patients; special deep venous access material for obese people and a special sphygmomanometer for obese people.

“Our Bill aims to establish a comprehensive set of rights and protections for people living with obesity, which is a complex and multifaceted health condition that affects a significant number of individuals. Obesity is not just an aesthetic issue, but also a health condition that can profoundly affect people’s quality of life, self-esteem and social participation. By instituting a specific Statute, Amazonas will demonstrate a clear commitment to inclusion and equality, ensuring that people with obesity have the same rights and opportunities as all citizens.”

From January to mid-October 2022, the Primary Health Care (PHC) of Amazonas diagnosed overweight in about 64,100 adolescents aged 10 to 19 years old. Of these, more than 17,000 are obese. The number represents 7.3% of young people monitored by SUS.
