Rapporteurs present favorable opinions to Dino and Gonet – 12/06/2023 – Power

The rapporteurs for the nominations of minister Flávio Dino to the STF (Supreme Federal Court) and attorney Paulo Gonet to the PGR (Attorney General’s Office) presented their favorable opinions this Wednesday (6) at the CCJ (Constitution and Justice Commission) of the Senate.

The rapporteur for Dino’s nomination, Weverton Rocha (PDT-MA) said that the Minister of Justice “never left the legal world” even though he spent the last few years in politics — as a federal deputy, president of Embratur, governor and, finally, minister.

The senator also highlighted that Dino’s master’s thesis “laid the basis” for the creation of the CNJ (National Council of Justice). In the work presented in 2001 when he was still a federal judge, Dino defended the need for external control for the Judiciary.

“He is a recognized and admired figure in the legal and political worlds. He has had successful experiences in carrying out the functions of the three Powers of the Republic. At the beginning of this year, he was chosen by President Lula to hold the position of minister, having initially faced with the rigor, security and firmness necessary for the traumatic events of January 8th”, says an excerpt from the opinion.

The government leader in the Senate, Jaques Wagner (PT-BA), rapporteur for Gonet’s nomination, stated that his performance “demonstrates professional experience, adequate technical training and intellectual and moral affinity for the exercise of the high position for which he was appointed indicated”.

“The distinguished nominee was ranked first in the competition for the position of Public Prosecutor of the Federal District and Territories, held in 1986, and also ranked first in the national competition for the position of Public Prosecutor held in 1987, having chosen for the career of the Federal Public Ministry.”

Dino and Gonet will be questioned by the CCJ on December 13th. The expectation is that the plenary analysis will take place next, on the 13th or the following day, the 14th. To be approved, the nominees must receive the vote of 41 of the 81 senators. Voting is secret.

In the CCJ, approval depends on a simple majority. Despite this, the commission’s decision is only advisory, and does not prevent names from being taken to the Senate plenary even with scores contrary to the nominations.

Dino and Gonet will be judged not only on the same day, but also simultaneously.

The format was used last week during the hearing of the ten nominees for the CNJ (National Council of Justice) and the CNMP (National Council of the Public Ministry). The same happened with the three nominated to the STJ (Superior Court of Justice), in October.

The joint hearing should not only speed up the process, but also lower the temperature, avoiding direct impacts. In this setup, Dino and Gonet would answer more than one question at once; senators, in turn, would have less time to speak.
