Brasilia DF) – The Inspector General of the TSE (Superior Electoral Court), Benedito Gonçalves, again defended this Tuesday (27) the inclusion, in the process against former President Jair Bolsonaro (PL), of the coup draft learned in January this year in the home of former Minister of Justice Anderson Torres.
Benedito is the rapporteur for the action that could make Bolsonaro ineligible for eight years. He began to present the arguments for his vote on Tuesday night, on the second day of the TSE trial.
The draft seized by the PF dealt with the decree of a state of defense after Lula’s election, and its inclusion in the process is questioned by Bolsonaro’s lawyers.
Benedito said that the inclusion of the document in the process does not contradict the thesis established in the judgment that acquitted the ticket Dilma Rousseff / Michel Temer, in 2017. , he said, repeating the previously expressed understanding.
After Benedito finishes, it will be the turn of the other six members of the electoral court to vote. The expectation is that the conclusion of the judgment will be in the next session, scheduled for 9 am on Thursday (29).
The action filed by the PDT targets Bolsonaro and Walter Braga Netto, a former minister who was a candidate for vice on the defeated ticket of the PL to the Presidency in 2022. The former president is accused of having committed abuse of political power and misuse of the media during a meeting with ambassadors held in July last year.
After Benedito, the ministers of the STJ (Superior Court of Justice) Raul Araújo, Floriano de Azevedo Marques and André Ramos Tavares will vote and, finally, the members of the STF (Supreme Court of Justice) Cármen Lúcia, Kassio Nunes Marques and Alexandre de Moraes .
The scenario is considered adverse for Bolsonaro, and the tendency is for him to be declared ineligible. The ex-president’s lawyer, Tarcísio Vieira de Carvalho, already admits to resorting to the STF in case of defeat at the TSE.
In defending Bolsonaro’s punishment on the first day of the trial, last Thursday (22), the legal representation of the PDT argued that there was an attempted coup d’état.
The event with the ambassadors lasted about 50 minutes and was broadcast on TV Brasil. At the time, the government’s Secretariat of Communication barred the press, allowing only vehicles that committed to broadcast the event live.
