Randolfe project that prohibits noisy fires is approved by CAE – News of Brazil

Bill (PL) N°05/2022 deals with the prohibition, throughout the national territory, of the manufacture, trade, transport, handling and use of fireworks. The proposal was authored by senator Randolfe Rodrigues (Rede-AP).
The PL was approved, this Tuesday (03), by the Economic Affairs Committee (CAE) of the Federal Senate. The project does not prohibit the use of visual fireworks, but it prohibits the manufacture, trade, transport and handling of fireworks and other pyrotechnic devices that produce noise, whether for use in public areas or private places. The PL goes to the Constitution and Justice Commission (CCJ) for consideration.
“Our objective is to protect animals, which in some cases suffer from health problems caused by the explosion of fireworks. In addition to the negative impact on people with Autism Spectrum Disorder (ASD), who have sensory hypersensitivity to the noise caused by these artifacts”explained the senator.
According to the justification of the parliamentarian’s proposal, the noise from exploding fireworks can reach 150 to 175 decibels. The limit supported by humans is 120 to 140 decibels.
The text provides for fines for those who fail to comply with the law. For legal entities that manufacture, transport, sell or import prohibited products, they will be fined up to 20% of the gross revenue of the last fiscal year.
With regard to individuals who use or manufacture, import, transport or sell the prohibited products mentioned in the text, they will be subject to a fine of R$2,500 to R$50,000.
