Randolfe meets with AGU to defend the right of EMDESUR servers in Transposition – News of Brazil

This Thursday (13), Senator Randolfe Rodrigues (REDE) met with the Attorney General of the Union, Jorge Messias, to discuss the process of transferring civil servants in Amapá, mainly with regard to the Municipal Development Company and Urbanization of Macapá (EMDESUR). In December 2021, the Special Transposition Commission asked for a technical analysis by the Attorney General of the National Treasury (PGFN) on the right of servers to transpose to the Union framework.
Process No. 19975.121850/2021-94, which deals with the issue of EMDESUR, has been dragging on since 2019. Senator Randolfe asked the AGU to deal with the Ministry of Management’s legal consultancy to analyze the EMDESUR process and forward it to the Consultancy- Union General.
The parliamentarian argues that the EC guarantees the right for those who had an employment relationship with organs of the former Territory, the State and the city halls, and also, with public companies and mixed economy companies created by the former Territory or by the Union to act within the scope of the former Territories.
“EMDESUR was created by the city of Macapá in 1980, when the condition of federal territory was in force, when the President of the Republic appointed the Governor of the Territory and the Governor appointed the mayors of the municipalities, in this way it fits in what determines the amendment”, said the senator.
Another point that contributes to the EMDESUR servers is the fact that the payment of the payroll and social charges of the servers were paid 100% with funds from the municipality’s coffers, resources passed on pursuant to a specific agreement entered into between the city hall and EMDESUR to hiring of personnel to work directly in the departments and municipal bodies.
