Public Ministry of Spain is against provisional release to Daniel Alves

Prosecutors from the Public Ministry of Spain demonstrated this Monday (6) against the granting of provisional release to Daniel Alves, arrested since January 20 for alleged sexual assault against a 23-year-old woman. The main argument is the risk of the Brazilian athlete fleeing the country. The information is from the newspaper The Vanguard.
Daniel Alves’ defense, led by lawyer Cristóbal Martell, filed an appeal against the preventive detention of the former Barcelona player. In a 24-page document, it is claimed that there is no risk of fleeing Spain, suggesting the delivery of the passport and even the use of a “telematic bracelet”, similar to an electronic anklet.
The court in Barcelona will receive the allegations from the complainant’s lawyers in the next few days. Ester García, the alleged victim’s lawyer, must explain why it is against Daniel Alves to answer the charges in freedom. It is worth mentioning that Brazil does not extradite Brazilians, which could free the player from Spanish justice in case of flight to the country.
There is no deadline for the judgment of the appeal, which will be decided by the Court of Instruction 15 of Barcelona. According to the report, the tendency is for the analysis to come out in less than a month because it is someone who is already in prison.
The parties must also position themselves on the request of Fecasarm and Spain Nightlife, employers of Spanish nightlife, which filed a petition in court to appear in the case as a popular accusation. At the moment, the Public Prosecutor’s Office has positioned itself against “for lack of accreditation of legitimate interest and lack of legal coverage”.
