PT contests Rosângela Moro’s electoral return to Paraná

The PT appealed the decision of the Electoral Court in Curitiba that allowed deputy Rosângela Moro (União) to transfer her electoral domicile back to Paraná. In 2022, to run for office, she changed her domicile to São Paulo, where she considered she had a better chance of being elected. Now, close to the trial at the Regional Electoral Court of Paraná that could revoke her husband’s mandate as senator, Sergio Moro (União), she asked to return, which allows her to run for office if he loses his mandate.

“It is not possible for a representative of the state of São Paulo to be able to establish her electoral domicile in another unit of the federation during the course of her term of office. This means that the transfer of the defendant’s electoral domicile implies unquestionable fraud in the representation of the São Paulo electorate in Parliament”, says the PT’s action.

The party also argues that maintaining the decision that authorized the transfer could constitute a “supervening loss of eligibility”. As the electoral domicile in São Paulo is cancelled, the requirement that allowed his candidacy would be missing. The same would happen if, hypothetically, she was a foreigner and lost her Brazilian naturalization or was expelled from the party, other eligibility requirements.

“The subsequent loss of the eligibility condition would lead to the contested party losing her mandate as Federal Deputy, and, ‘in view of the relevant public interest that arises, it seems reasonable that the Electoral Court could terminate the candidate’s registration’”, says the PT , citing the understanding of jurist José Jairo Gomes.

The PT, however, did not ask for the revocation of the mandate, only the cancellation of the transfer.

In Paraná, the dispute for Sergio Moro’s senatorial position has already begun, although the trial has not even started – it is scheduled for April 1st at TRE-PR. He is accused by the PT and PL of spending more than allowed on the campaign, especially because he switched from running for president to running for senator. Deputy Gleisi Hoffmann (PT), deputy Ricardo Barros (PP) and former deputy Paulo Martins (PL) are the most interested in the seat.

On the social network X, Moro mocked the PT. “There are no elections on the horizon, but the fear that the PT has of Rosângela Moro is worth noting. Cry, PT,” the senator posted.

For the group Prerogativas, of lawyers critical of Lava Jato, Rosângela’s changes characterize “electoral fraud”. “When she ran as a candidate for São Paulo, Prerogativas denounced that she did not have any intimacy with the state, the city, with the problems of the citizens who live here, that she did not have any type of identity with the culture of our people. Now she simply changes her affiliation, with a clearly electoral objective. São Paulo had 70 deputies and now has 69. It needs to return this mandate to the population of São Paulo and hand it over to the alternate”, says the group’s coordinator, Marco Aurélio de Carvalho.
