Blocking of assets aims to reimburse BRL 626,000 in damages at the XVIII Cocoa Festival
Manaus (AM) – The Public Ministry of Amazonas (MPAM), through the Public Prosecutor’s Office of Urucurituba, filed, last Friday (9), a Public Civil Action (ACP) for Administrative Improbity against the mayor of Urucurituba, José Claudenor de Castro Pontes.
In the ACP, the Public Prosecutor Kleyson Nascimento Barroso requests, outright, in addition to the removal of the Mayor for a period of 90 days, the blocking of his assets, of three businessmen and four local companies, in the amount of R$ 626 thousand, in addition to the condemnation pursuant to art. 12, items II and III, of Law nº 8.429/92.
“Improbable conduct, consistent with undue waiving of bidding processes, with the consequent formalization of irregular contracts paid with public money, threaten public property and the principles that govern Public Administration, which is why the defendants must respond in court for their acts of misconduct. administrative dishonesty”
stated the Public Prosecutor.
In addition to the Mayor, Jersey de Nazareno Sisnando dos Santos, Anderson da Silva Lima and Marcelo José Coutinho Lins are also processed, as well as the companies Jersey de Nazareno Sisnando dos Santos ME, Choperia Copacabana Ltda., Marcelo José Coutinho Lins (Passefly), and J Music Editora e Produções Artísticas Ltda..
The hiring of singers Joelma and Simone Mendes for the XVIII Cocoa Festival in Urucurituba had already been the subject of a suspensive action proposed on 4/14/2023 and accepted by the local court. In view of the granting of urgent relief, the Municipality terminated the contract with J Music, responsible for hiring Joelma at a cost of R$ 150,000, presenting the company Jersey de Nazareno Sisnando dos Santos as the sponsor of said contract, through a cooperation agreement also signed with Choperia Copacabana, which would be responsible for selling drinks for the event.
The technical cooperation agreement (Law nº 13.019/2014) is signed between public administration bodies and entities or between these and non-profit private entities, aiming at the execution of work programs, projects, activities or events of reciprocal interest, of which there is no obligation to transfer resources between the participants, which, according to the Public Prosecutor Kleyson Barroso, in fact did not occur.
“The companies, graciously contracted and using public resources destined for the realization of the XVIII Cocoa Festival, had an astronomical profit, with the exploration and commercialization of alcoholic beverages, food, frontstage entrances and cabins, without spending a penny, given that the entire structure of the XVIII Cocoa Festival is funded with public funds”
he declared.
