The proposal includes same-sex people in the list of people who cannot marry

The Social Security, Social Assistance, Childhood, Adolescence and Family Committee of the Chamber of Deputies approved, by 12 votes to five, a bill that prohibits same-sex marriage. The proposal includes same-sex people in the list of people who cannot marry. Currently, parents, children and siblings are on this list.

The text now goes to the Human Rights and Constitution and Justice (CCJ) committees of the House. In addition to civil marriage, the project also establishes that public authorities and civil legislation cannot interfere with the criteria and requirements of religious marriage.

“It is not a relationship of selfishness between two, but of altruism in view of the perpetuation of the species. Hence the exclusive need, through marriage between a man and a woman”,

argued rapporteur Pastor Eurico (PL-PE).

The resumption of the project is sponsored by parliamentarians opposed to the government and linked to the evangelical bench in the Chamber. The collegiate, in which the vote took place, has a majority made up of conservative deputies.

PL 580/2007, originally presented by former deputy Clodovil Hernandes, intended to amend the Civil Code to recognize marriage between people of the same gender. At the time, there was no guarantee that recognized union between LGBT+ people.

The rapporteur, however, mischaracterized the initial proposal and added eight projects to the original text, one of which “establishes that no relationship between people of the same sex can be equated to marriage or a family entity”.

For deputy Erika Kokay (PT-DF), voting on the project encourages prejudice against the LBTQIA+ population. “There is a rush to throw more than 80 thousand couples into limbo who today have their relationships extremely regulated, the rush is to stimulate an LGBTQIA+ phobia, which turns into cruel statistics, the rush is to deify the discourse of death, and here we want withdraw rights”, he stated.

Same-sex marriage was recognized in 2011 by unanimous decision of the Federal Supreme Court (STF). In other words, although same-sex marriage is not guaranteed by law, the Court’s decision guarantees that same-sex couples have the same rights and duties that Brazilian legislation already establishes for heterosexual couples.

In 2013, the National Council of Justice (CNJ) required, through Resolution No. 175/2013, that all registry offices in the country enable and celebrate civil marriages between people of the same gender.
