Demonstrations in favor of the terrorist group that attacked Israel, under chants of “Long live Hamas”, organized by left-wing parties and movements such as PCO, PSOL, PCB and PSTU, are considered a crime according to the Brazilian Penal Code.

As shown by People’s Gazettethis Wednesday (11), five days after the extremist group’s attacks on Israel, the parties held demonstrations in Brasília, São Paulo and Rio de Janeiro alongside movements linked to the Palestinian cause and workers, such as the Palestinian Arab Federation of Brazil (Fepal), the Federation of Unions of Technical-Administrative Workers in Education (Fasubra Sindical), the National Movement for the Fight for Housing (MNLM), among others.

“Pro-Palestine protests do not involve any criminal conduct. What is a crime without a shadow of a doubt are demonstrations that consist of choruses of ‘Long live Hamas’ and applause and explicit support for the group in a context in which it is clear that they are supporting what Hamas did – that is, killed people at the hands of Hamas. carry out a terrorist attack”, explains Ronaldo Lara Resende, prosecutor at the Public Ministry of Rio Grande do Sul and professor of Criminal Law and Criminal Procedure.

The crime, according to the jurist, is provided for in article 287 of the Penal Code, which consists of publicly apologizing/praising a criminal act and the perpetrator of a crime.

“In this case, there was support for both – both for the acts carried out by Hamas and for the group itself, because when praising the group for what it did, one is also praising what they did, then there is an incidence, despite constituting a crime. alone”, says the prosecutor.

During the demonstration in São Paulo, the national director of the PCO, Francisco Muniz, defended the terrorist group’s attacks, classified the acts as an “anti-imperialist struggle” and said that the party is “1,000% with Hamas”.
