President of the Court of Justice orders collection of arrest warrants against convicts in the process of Operation Eclésia – News of Brazil

Judge Adão Carvalho, president of the Court of Justice of Amapá (Tjap), ordered the issuance of a release permit in favor of Lindemberg Abel do Nascimento, reserve colonel of the Military Police of Amapá, and the collection of arrest warrants issued against the former state deputies Edinho Duarte and Moisés Souza and against Edmundo Ribeiro Tork and Janiery Torres, all involved in the criminal action of Operation Eclésia, launched in 2012 within the scope of the Legislative Assembly of Amapá.
Adão Carvalho’s decision was taken in compliance with an injunction from the Federal Supreme Court (STF) informing Tjap of the entire content of the decision issued in the records of the precautionary measure in habeas corpus in order to determine the suspension of the execution of the sentences imposed on Jorge Evaldo Edinho Duarte Pinheiro.
Through petitions, Edmundo Ribeiro Tork, Janiery Torres Everton, Vitório Miranda Cantuária, Moisés Souza and José Maria Miranda Cantuária requested the extension of the effects of the decision that suspended the execution of the sentences imposed on Edinho Duarte.
In the decision that suspended the execution of the sentences imposed on Edinho, Minister Nunes Marques wrote: “In view of the above, I grant the precautionary measure, with a determination to suspend the execution of the sentences imposed on the present patient in the file of Process 0000937-35.2012, pending before the Court of Justice of the State of Amapá”.
In turn, the other co-defendants claimed the extension of its effects also in relation to them, based on article 580, of the Code of Criminal Procedure (CPP).
Given this panorama, following the same understanding adopted, given the similarity of the factual-legal and procedural situation of the co-defendants and the absence of an eminently personal nature of the decision handed down by the STF, the judge Adão Carvalho understood that the intended extension of effects was appropriate, hence having determined full compliance with the decision handed down by the Federal Supreme Court in favor of Edinho Duarte, until further decision by the Superior Court, and extend the effects to the others, collecting the arrest warrants for Moisés Souza, Edmundo Tork and Janiery Torres.
