Faced with new evidence of what could be the plot of a coup attempt by the core of the Jair Bolsonaro (PL) government, brought to the public by a Federal Police operation last week, a legal debate was opened on possible accountability for the former -president and figures around him.

According to the decision of the STF (Supreme Federal Court) minister Alexandre de Moraes who authorized the operation, the facts reported have materiality of the crimes of coup d’état and abolition of the democratic rule of law. But lawyers discuss what planning a crime would be — and whether it would be punishable — and what would constitute a concrete attempt to commit it.

This debate includes elements such as the meeting in which Bolsonaro mentioned coup plans to ministers and messages that indicate that the then president dealt with documents with this content with the military. The possible association of the different nuclei of the plan demonstrated by the PF with the attacks on January 8th is also open.
