Podcast: the analysis of the time frame in the STF – Folha – 06/07/2023 – Podcasts

The Federal Supreme Court resumes this Wednesday (7) the judgment on the time frame for the demarcation of indigenous lands in Brazil. Analysis of the case was interrupted in September 2021, with a request for a view from Minister Alexandre de Moraes, when the score was 1-1 — Edson Fachin voted against the thesis, Kassio Nunes Marques, in favor. At the time, the government of then-President Jair Bolsonaro (PL) was in favor of the milestone; now, President Luiz Inácio Lula da Silva (PT) has waved against the thesis.

Last week, the Chamber approved PL 490, which deals with the time frame and other aspects of land use. The bill was processed urgently, with the support of the ruralist caucus, in an attempt to anticipate the decision of the STF – Congressional opposition to the idea that the Supreme Court decides the issue has existed since the beginning of the trial. In the vote, the government leadership advised against the text, but part of the subtitles of the base released the countertops, and the project was approved with 283 votes in favor and 155 against.

The Planalto counts on the Senate to curb what it sees as a setback. The president of the House, Rodrigo Pacheco, has already warned that he will not speed up the procedure and must follow all the rites in the analysis of the PL. The government’s bet is that the delay should give the Supreme Court time to close the judgment.

After the decision of the Chamber, protests were held in different cities of the country. Groups that organized the demonstrations are mobilized again, with camps set up in Brasília, to also put pressure on the Federal Supreme Court.
