The Chamber of Deputies approved, last Wednesday (14), Bill No. 2720/23, authored by Deputy Dani Cunha (União-RJ), which aims to typify the crime of discrimination against politically exposed persons, whether parliamentarians , judges, heads of the municipal or state executive branch, ministers and other public officials. Federal deputy Amom Mandel (Cidadania-AM) voted against the proposal.

Of the eight deputies on the Amazon bench, only three were against Amom: Sidney Leite (PSD-AM) and Alberto Neto (PL-AM). On the other hand, deputies Saullo Vianna (UB-AM), Fausto Jr. (UB-AM), Silas Câmara (REP-AM), Átila Lins (PSD-AM) and Adail Filho (REP-AM) were in favor of the initiative, which also benefits the relatives of politically exposed persons, up to the second degree, the spouse, partner or stepchild.

“It is absurd, there would be no way to vote otherwise. Proposing a project to make discrimination against politicians a crime is to legislate for its own sake, it makes no sense to create this shield”, declared Amom.

Among the points of the project, it becomes a crime with a penalty of up to 4 years in prison to discriminate against politicians who respond to a process or investigation, for corruption, impropriety or the like. In addition, refusal to open or maintain an account, grant credit or another service to politically exposed persons and their relatives for the reasons listed also becomes a crime. In cases where there is a refusal to provide services, banking institutions will have a period of five working days to explain the reasons to applicants. Shielding politicians, authorities and family members is valid for five years after leaving office.

The National Registry of Politically Exposed Persons (CNPEP), available on the Transparency Portal, will serve as a database for identifying these people, in addition to other official means of public management.

The point that provided for the criminalization of cases of insult to politically exposed persons was removed from the project by rapporteur Cláudio Cajado (PP-BA). The project will be submitted to the Senate, where it may undergo further modifications before being transformed into law.
