PGR opined against search and seizure against Bolsonaro and Michelle

The Attorney General’s Office (PGR) opined against the search and seizure determined by Minister Alexandre de Moraes against former President Jair Bolsonaro (PL), this Wednesday morning (3), carried out by the Federal Police. In an opinion sent to the minister, deputy prosecutor Lindora Araujo said that the PF investigation into the insertion of false data into Ministry of Health systems to prove that Bolsonaro and his daughter Laura would have been vaccinated in Brazil does not have minimally consistent evidence to link the former -president and former first lady Michelle Bolsonaro to the alleged crimes committed.

The body rules out that they participated in the act as co-authors and participants and imputes the infractions to Bolsonaro’s assistant, Colonel Mauro Cid. “Differently from the plot drawn up by the Federal Police, what emerges is that Mauro Cesar Barbosa Cid would have architected and led all the criminal action, in absentia, without the knowledge and without the consent of the former President of the Republic Jair Messias Bolsonaro”, says the document.

“There is no minimum evidence to support the involvement of former President of the Republic Jair Messias Bolsonaro with the enforceable acts of inserting false data regarding vaccination in the Ministry of Health systems and with the possible use of ideologically false documents”, reinforced the sub-attorney Lindora Araujo.

In the opinion, she also considered that the former president and his family had a diplomatic passport and, with it, they would not need to prove vaccination against Covid to enter the United States. PF investigations showed that false data were entered into ConectaSUS on December 21, and removed on the 27th, shortly before Bolsonaro and his family left for Florida, at the end of the presidential term.

The PGR says that, in theory, Bolsonaro and Laura would not have been charged to present the vaccination card to enter the USA. “Despite the issuance of vaccination certificates against Covid-19 through the ConectaSUS application, there is no indication in the information framework that, in fact, Jair Messias Bolsonaro was guided and acted for his own benefit or that of his daughter Laura Firmo Bolsonaro, in relation to facts and situations that required the aforementioned proof of vaccination ”, says the PGR.

The body also records that Mauro Cid managed Bolsonaro’s account on the government portal, which gives access to the system that issues the vaccination certificate. The PF investigation showed evidence that the order’s assistant would have entered the system for this.

Another PGR argument is the fact that Bolsonaro has always said he has not been vaccinated. An eventual authorization to enter false data that he had taken the vaccine would be “unnecessary”, “absolutely paradoxical” and, if revealed, would bring him “irreparable political damage, precisely in the year in which he would run for a new term as President of the Republic” .

Lindora Araujo still opined against the search and seizure against Michelle, considering that the only element that would link her to the alleged crimes is the fact that she is Laura’s mother. She stated that the PF request is still based on “mere conjectures and presumptions”, in reference to the suspicion that it would be in the interest of Bolsonaro and Michelle to issue a false card for their daughter on the eve of the trip to the United States.

Moraes dismissed all these arguments. He authorized the measure against Bolsonaro, considering that it would not be “credible” that Mauro Cid would have devised the scheme.

“It is a notorious fact that Mauro César Barbosa Cid, investigated in these records, held the position of assistant to former President of the Republic Jair Messias Bolsonaro, under the terms of Law 1.608/52, carrying out his personal determinations. There is no indication in the case file that lends credibility to the version that the aide-de-camp of former President of the Republic Jair Messias Bolsonaro could have commanded a relevant criminal operation, aimed directly at the then representative and his daughter LFB [Laura Firmino Bolsonaro]without at least the knowledge and acquiescence of the former, a circumstance that can only be determined by carrying out the search and seizure measure required by the police authority”, justified the minister.

Moraes, however, agreed with the PGR that the search against Michelle, requested by the PF, should not be authorized. He said that there would be no “intersubjective conditions” with the other investigated, nor description of her specific conduct in the case.

Even so, according to Bolsonaro, the PF would have, during the operation at his home in Brasília, photographed Michelle’s vaccination card, who was vaccinated in the US in 2021. When reporting the action in an interview with Jovem Pan, the former president almost cried when telling what would have happened. “They found my wife Michelle’s vaccine card… yeah… they took the picture, the suspicion was fraud. She was vaccinated in 2021 in the United States ”, he said, his voice breaking.

“I call it an operation to carve you out. You could ask about the vaccine for me, card, I would answer without any problem. Now, it’s enormous pressure, 24 hours a day, all day, from before I took office until now, I don’t know when it will end. Why do I get emotional? Messed with me, no problem. When it goes to a wife, to children, then the business is… inhuman, inhuman”, he said afterwards.
