Peixoto proposes a law that requires labor discharge from companies that provide services to the municipality

According to the text, companies that provide services to the Municipal Executive will only receive after proving the salary payment of their employees.

Manaus (AM) – The plenary session of the Manaus City Council (CMM) this Wednesday (9) was under discussion in the Bill of Law nº 223/2021 that requires companies providing services to the municipality to prove monthly the discharge of labor obligations. Authored by councilor Peixoto (Agir), the PL aims to safeguard the rights of workers, especially the monthly payment of wages.

The project, which has been pending in the House since 2021, received a favorable opinion from the 3rd Commission on Finance, Economy and Budget and, with the approval obtained today, goes to the 7th Commission on Services and Public Works. During the vote, Peixoto made a point of remembering that the purpose of the action is to guarantee the employee’s greatest labor obligation.

“This project guarantees tranquility to the worker of a company that provides services to municipal management. What we have seen, since the beginning of the mandate, is that from time to time some companies do not comply with their labor obligations”,

highlighted.

During the session, some parliamentarians emphasized the importance of the project, such as councilor Wallace Oliveira (without party). He highlighted Peixoto’s initiative, stating that the PL will fight a recurring problem that he classified as a “snowball”.

“Today there are some categories that have not been paid for 4 months and then, at times, these categories are not being paid because the company, the cooperative or whatever it is did not present some information necessary for the payment to take place and, subsequently, the payment of employees who have already carried out the work and are there without receiving 3, 4 months. I want to congratulate Councilman Peixoto, ask for his subscription to the aforementioned project, so that we try not to have these situations that we once had here”,

said the MP.

Peixoto emphasizes that the project aims to strengthen compliance with contractual obligations, while “protecting” the municipality in cases of default by the contractor and avoiding any subsidiary liability of the contracting government.

“The idea of ​​the PL is to give guarantees to workers so that they have their rightful remuneration guaranteed, but at the same time it protects the municipality by preventing it from being involved in actions on behalf of service providers”,

explained.

The councilor also made a point of highlighting that although there are already guarantees of discharges such as FGTS and INSS, in the hiring of outsourced workers by the City of Manaus, Bill No. 223/2021 has as its main focus the guarantee of monthly payment of salaries.

“The main labor obligation is not to deposit FGTS, the main and greatest labor obligation is salary payment, the payroll. Because despite being a prerogative of the PIS and FGTS payroll for contracting bids, some companies may even be even with these obligations, but still delay wages. With the implementation of the Law, to receive from the City Hall, companies will have to prove the salary payment of the previous month. This is how we are going to guarantee the monthly right of the worker”, concluded Peixoto.

The project was signed by councilors Kennedy Marques, Ivo Neto, Sassá da Construção Civil, Professor Samuel, Wallace Oliveira, Raiff Matos and the president of CMM, Caio André.
