Pacheco releases STJ nominees after impasse due to alleged favoritism

The president of the Senate, Rodrigo Pacheco (PSD-MG), sent the names of Lula’s (PT) three nominees for the Superior Court of Justice (STJ) to the Presidency of the Republic. The submission had been suspended since the 1st, when Pacheco ordered the Senate Advocacy to investigate whether there was favoritism on the part of the Board of Directors in relation to one of the nominees.
The Senate approved the nominations of the names of the lawyer Daniela Teixeira and the judges Teodoro Silva Santos and José Afrânio Vilela, but the Board of Directors of the House sent only the name of the lawyer to the Presidency.
The formality is necessary for the publication of the appointment in the Official Gazette of the Union (DOU).
Sending only the name of the lawyer raised the suspicion that the Board of Directors could be favoring Teixeira because, even if all the new ministers were inaugurated on the same day, her appointment would have been published before the other two approved ones, and this would place her ahead of them in the criterion of seniority in the court, used to define a series of functions within the court, including the moment to occupy the presidency of the STJ.
On the other hand, if Teixeira were appointed in the same formal act as judges Santos and Vilela, both would be tied in terms of seniority, and the tie would be broken based on age criteria – Teixeira is the youngest of the trio, while Santos is the oldest, and would take precedence.
If it is proven that a public servant has been involved in some type of fraud, a disciplinary process will be opened which could culminate in dismissal from public service.
