Pacheco: mandate for STF minister is legitimate discussion – 02/14/2023 – Power

The president of the Senate, Rodrigo Pacheco (PSD-MG), said this Tuesday (14) that the discussion on mandates for ministers of the STF (Federal Supreme Court) and on the scope of monocratic decisions — taken by only one of the magistrates, and not by all.

During an event at the BTG Pactual bank, Pacheco stated that having this debate is much better than “being that insanity of attacking the figure, the person of the minister” of the Supreme Court. The president of the Senate said that the STF’s own limitation of competence is “very palatable”.

“You discuss the scope of a monocratic decision by a STF minister or any superior court minister: it is an honest discussion. palatable,” he said.

“All these discussions are possible discussions, [que] there are in other countries, and what we could do in parliament instead of being that insanity of attacking the figure, the person of the Minister of the Federal Supreme Court, as if that were going to solve the problems of the institutional relationship between the Powers. This is a mistake, this is a mistake.”

Today, the ministers of the Supreme Court do not have a mandate, but are obliged to retire at the age of 75. They are appointed by the President of the Republic, reviewed by the CCJ (Commission on Constitution and Justice) of the Federal Senate and approved by the plenary of the House.

Faced with the offensive of the candidacy of Senator Rogério Marinho (PL-RN) against the STF and Minister Alexandre de Moraes, Pacheco has been waving with the possibility of discussing the functioning of the STF. Marinho ended up defeated in the election for President of the Senate by 49 votes to 32.

In an interview with Sheet, on the eve of the dispute, Pacheco said that the Senate can discuss changes in the court, when asked about the priority guidelines of the House in the next two years. The senator even said that he has already spoken with ministers of the Court about this.

“It is important that, in the Judiciary, there is appreciation of the judges and modernization of the equipment of the Judiciary, and, eventually, changes in the Federal Supreme Court itself, which is something much talked about today and, obviously, I have already communicated to the ministers that it is natural that we can have discussions of this nature in parliament.”

Pacheco reached the presidency of the Senate for the first time with the support of Jair Bolsonaro (PL) after the then president of the House, Davi Alcolumbre (União Brasil-AP), was prevented by the STF (Federal Supreme Court) from running for reelection.

Throughout his term, however, the senator from Minas Gerais distanced himself from the former president of the Republic and picked a fight with the Palácio do Planalto when he decided to reject a request for impeachment made by Bolsonaro against STF minister Alexandre de Moraes.

In the dispute against Marinho, Pacheco positioned himself as the candidate capable of defending democracy and stopping the Bolsonarist offensive against the Supreme — especially after the invasion and attack on the headquarters of the Three Powers, on January 8.

During this Tuesday’s event, the president of the Senate said that mistakes by the Judiciary must be corrected within the limits of the Judiciary itself, and that he would never allow the impeachment of a minister due to a decision taken. “Judicial decision is appealed when you disagree,” he said.

“When people talk about the impeachment of a STF minister as if this were a solution for all ills, I say: this is not a solution for all ills. And I would never allow an impeachment of a STF minister for a decision that he took,” he told the audience of investors.
