Pacheco holds Lula’s nomination due to alleged favoritism – 11/02/2023 – Power

The president of the Senate, Rodrigo Pacheco (PSD-MG), suspended the sending of the nomination of lawyer Daniela Teixeira to the STJ (Superior Court of Justice) to the Palácio do Planalto.

Pacheco also ordered the installation of an inquiry to investigate complaints of Daniela’s benefit by having only her name forwarded to the government for publication in the Official Gazette of the Union.

Pacheco’s decision does not have the power to annul its approval by the Senate plenary. In addition, the appointment of federal judges José Afrânio Vilela and Teodoro dos Santos were also approved.

The opening of the inquiry was reported by the newspaper O Globo and confirmed by Sheet.

The suspicions of favoring Daniela occur because, in theory, she could benefit if her name was published earlier in the Official Gazette of the Union than the other nominees.

According to the seniority criterion, for example, she could become a member of the TSE (Superior Electoral Court) before the other nominees.

People who follow the topic heard by the Sheet emphasize, however, that it is ultimately up to Lula (PT) to choose the date for publishing the nominations.

Even if the documents relating to Vilela and Teodoro arrive after Daniela’s, they say, the president is under no obligation to follow the order of arrival when defining publications in the Official Gazette.

According to interlocutors, Pacheco also signed the orders sending the appointments of federal judges. What the investigation must evaluate, they say, is the reason why so far only Daniela’s appointment has been forwarded to Planalto.

Daniela Teixeira was approved by the Senate on October 25th with 68 votes in favor and 5 against, and will occupy one of the seats reserved for lawyers in the court. She was the only woman on the list of three names of defenders chosen by STJ ministers for Lula to nominate.

Since entering the competition to occupy a place on the court from the lawyers’ class, she was seen as a favorite, due to her good standing both in the OAB (Brazilian Bar Association) and in the PT government.

On the same day it was approved, the Senate rejected the nomination of the representative for the DPU (Union Public Defender’s Office), Igor Roque. The House, once a safe haven for the Planalto, became a minefield for Lula, as shown by the Sheet.
