Orlando Silva delivers the final version of the Fake News PL with changes

Deputy Orlando Silva (PCdoB-SP) filed on Thursday night (27) the final version of Bill 2.630/2020, also known as the Fake News PL. The vote on the proposal by the plenary of the Chamber of Deputies is scheduled to take place next Tuesday (2). Earlier, Silva met with the mayor, Arthur Lira (PP-AL), to define the last points of the text.

Silva changed points in the text after facing resistance to the processing of the matter. Earlier this week, the Chamber of Deputies approved the urgency regime for the analysis of the PL. As a result, the project will not be discussed in committees and will be voted on in plenary. During the urgency vote, the opposition on the part of the parliamentarians was explicit, the opposition tried to postpone the vote, but without success.

The rapporteur removed from the new version the possibility of creating an “autonomous supervisory entity”, with the power to “request, receive, obtain and access data and information from third-party content digital platforms”. The withdrawal of the body, which would be a kind of regulatory agency, was made after resistance from party leaders.

Among the sanctions established for social networks is the temporary suspension of activities, a measure that was already included in the previous version. But, after the last changes, the point that authorized the “prohibition of the activities” of the platforms was removed from the project.

In addition, the substitute presented by the rapporteur expressly included that the application of the new legislation must respect “the free exercise of religious expression and worship, whether in person or remotely, and the full exposition of its dogmas and sacred books”. This point had been questioned by parliamentarians, such as federal deputy Deltan Dallagnol (Podemos-PR).

The old version of the text only stated in the sole paragraph that “the prohibitions and conditions provided for” in the bill “will not imply restriction on the free development of the individual personality, on free expression and on artistic, intellectual, satirical, religious, political content. , fictional, literary or any other form of cultural manifestation, pursuant to arts. 5 and 220 of the Federal Constitution”.
