The Electoral Attorney General issued an opinion for the approval of the merger between the PTB (Brazilian Labor Party) and Patriotas parties. The opinion, dated August 9, has the signature of the deputy electoral attorney general Paulo Gustavo Gonet Branco. According to Kassyio Ramos, who should assume the national general secretariat of the new party (Mais Brasil), by November the Superior Electoral Electoral Court should vote and approve the merger. Kassyo was the national president of the PTB after Roberto Jefferson was removed.
In November 2022, Mais Brasil, number 25, a party in formation from the merger between the Brazilian Labor Party and Patriota, requested registration of the Statute, the party program and its national governing body with the TSE, as per deliberation taken at a national convention held on October 26, 2022.
The PTB and Patriota began negotiations following the first round of elections, when they did not reach the barrier clause.
Since 2019, the distribution of monthly resources from the party fund, used for expenses related to the maintenance of the acronyms, is linked to the electoral performance of the parties. The sum of valid votes for candidates for federal deputy and the number of elected federal deputies are evaluated.
To overcome the norm and have access to benefits in 2023, parties should get at least 2% of the valid votes, with a minimum of 1% in nine states, or elect at least 11 federal deputies in one third of the federative units. The criteria will grow in a staggered manner until 2030.
Separately, PTB and Patriota did not reach the required minimum. The first party elected only one federal deputy, the second, four. The expectation of the directors is that, together, the acronyms manage to overcome the clause by the alternative criterion of 2% of the valid votes, with a minimum of 1% in nine states.
In the merger, two or more parties come together to form a new acronym, with new documents that govern the operation. With the officialization of the new party, the old ones are extinguished. It is an unusual type of party movement. The last ones occurred between Prona and PL, giving rise to PR, which would later be renamed PL; and between PSL and DEM, which gave rise to União Brasil.
