Netflix: expertise proves breach of 4K patent – 07/19/2023 – Panel SA

A judicial expertise proved that Netflix broke the patent of the American company Divx, which developed the system for transmitting videos in 4K (very high definition) today used by the streaming giant.

Produced by the consultancy La Rocca by order of the Court, the report was ready this Wednesday (19) and was sent to the 5th Corporate Court of Rio de Janeiro, where the process was initiated.

Divx sues Netflix in three other countries: US, Germany and China. They are the biggest markets for bigtech and, in them, there has been no progress in these processes.

In Brazil, Netflix had been resisting the authorization of the expert and even appealed to the STJ (Superior Court of Justice) against the determination of the Rio de Janeiro justice.

“It is an important victory that can reinforce the company’s strategy in disputes in other countries”, said Luís Felipe Salomão Filho, who represents Divx.

In the report, obtained by the column, the experts claim to have proven that the system used in streaming Netflix movies and series in very high definition follows the same criteria and standards patented by Divx.

Now, it will be up to the Justice to judge the merits. In the action, Divx asks Netflix to remove 4K videos from the air or start paying royalties for using the system.
