MPF defends filing of action for silence of Mauro Cid in CPMI

The Federal Public Prosecutor’s Office asked this Thursday (20) that the Federal Court of the Federal District dismiss the action presented by the Joint Parliamentary Commission of Inquiry (CPMI) that investigates the acts of vandalism on January 8, due to the fact that Lieutenant Colonel Mauro Cid, former assistant to then-president Jair Bolsonaro (PL), remained silent during the testimony.
During the deposition, which took place on the 11th, Mauro Cid decided not to respond to the questions from CPMI members. During more than eight hours of interrogation, the military said several times that he would resort to the right to remain silent, since he is the subject of eight investigations by the Judiciary, mainly by the Federal Supreme Court (STF).
In the document, the Public Prosecutor, Caio Vaez Dias, says that no criminal conduct on the part of the military has been proven. In response to the defense of the military, the prosecutor also said that the conduct object of this representation is atypical.
“There is no need to talk about abuse of the right to silence by Mauro Cid, since, despite having been formally committed as a witness by the President of the “CPMI – 8 de Janeiro”, Federal Deputy Arthur Maia, it appears that the questions addressed to him related to facts for which he is already being criminally investigated, as author or participant, his refusal to comment on them being legitimate”, said Dias, according to the excerpt of the document to which the newspaper The globe had access.
“It is opportune to note that Mauro Cid, despite being obliged to appear before the CPI, would not even have the obligation to sign a term or sign a commitment as a witness in the face of the facts established at the CPMI, considering that he is one of those investigated for the anti-democratic acts that occurred on January 8, 2023 in the federal capital”, said the prosecutor.
