MP files complaint against man tied with ropes after theft

The way he was treated does not nullify crimes he committed, says prosecutor

Sao Paulo-SP) – The Public Ministry of the state of São Paulo (MP) denounced for three crimes this Friday (16) the man who was carried by military police with his hands and feet tied. The information was confirmed by the São Paulo Court of Justice (TJ) and by the boy’s lawyer, caught with two boxes of chocolate.

According to prosecutor Margarete Cristina Marques Ramos, Robson committed theft, resisted arrest and corrupted a minor. Ademário, another investigated in the same incident, was also denounced for theft and corruption of a minor. The Justice will have to analyze the manifestation of the Public Prosecutor’s Office, which could make the two suspects defendants.

About the fact that one of them was tied with ropes, Maragarete wrote in the complaint that “the conduct of the military police does not have the power to annul the crimes committed by Robson, and will be duly investigated in specific procedures, since copies of this document have already been sent to the competent bodies for that purpose”.

The prosecutor also says that, according to the police, the boy “he disobeyed orders, they had to use force to handcuff him and they called in reinforcements to hold him back” is that “in the face of continued resistance” tied his feet with a rope. Lawyers from human rights entities heard by Agência Brasil assessed that in no scenario would such conduct by police officers be acceptable.

Robson had preventive detention decreed and maintained by the São Paulo Justice, despite the release of images that reveal police conduct during his arrest. The arrest report that the magistrate had access to at the custody hearing already contained information that he had been immobilized with a rope by the police, according to information from the Secretariat of Public Security (SSP).

However, the lawyer from Conectas Human Rights, who had access to the recording of the hearing, revealed that neither the Public Defender’s Office, nor the Public Prosecutor’s Office, nor the magistrate asked the boy any kind of question about the fact that he was tied up.

The Secretariat of Public Security (SSP) did not say whether the police officers involved were reported to the Military Court. On Friday (16), the agency informed that they were away from operational activities and that “eventual excesses are already being investigated”.

Robson’s defense released a note saying that “the structure of the State is disproportionate in all aspects, when it comes to reprimand, especially the poor, black and socially vulnerable, from their birth to their death.”

“We stand for something far beyond Mr. Robson, we defend the Democratic State of Law to an entire black community pushed since the formation of Brazil to the peripheries that are unaware of the sordid rules of this marked card game, precisely to imprison them. There is no rehab, there is no second chance. There is punishment without reflection and stigma forever. And the message is clear: vacate our beautiful streets, squares and places of good citizens, and, if necessary, we will tie them up, drag them around and nothing will happen to us”,

says the note.

Complaint

The MP’s complaint states that:

“According to the investigation, Robson first entered the market and placed several goods in a basket. As the employee already knew him from other thefts in the establishment, he pressed the panic button. Then Ademario and the teenager also entered and took more products. The employee, fearful, went outside the store and the trio left the place with the products”.

Regarding the prosecution’s complaint, lawyers José Luiz de Oliveira Junior and Estevão Silva claim that it highlights social distortions and that there is no objective proof that the three suspects for the theft were together.

“So much so that they were found separated, given that Robson himself was alone and the minor was found with Mr. Addition. And yet the accusation of unity of purpose persists”,

says the defense note.

“As for the resistance, it is imperative to wait for the arrival of the BodyCams of the police uniforms, as well as the images of the entrance of the building where everything happened to discuss in the future”,

adds defense.
