Moro unarchives PEC to force choice of PGR by list – 04/04/2023 – Panel

Senator Sergio Moro (União-PR) obtained the 27 signatures needed to unarchive, in a block, seven legislative proposals linked to the fight against corruption.

Among them, PEC 25/2020, which obliges the President of the Republic to choose the PGR (Attorney General of the Republic) among those appointed by the triple list formed with the vote of the category.

Since the election campaign in 2022, President Luiz Inácio Lula da Silva (PT) has been stating that he will not feel obliged to choose the next PGR from the list drawn up by prosecutors.

Although this requirement is not provided for by law, Lula always opted for one of her nominees in his previous governments.

In early March, he said he no longer thinks about this format.

“This is no longer the criterion I thought, because when I came to the Presidency I brought my union experience, so everything for me was a triple list. It’s already been proven that the triple list doesn’t always solve the problem. So, I’ll be more judicious to choose the next Attorney General of the Republic,” he declared at the time.

Part of the projects redeem points rejected by the National Congress in the anti-crime package that Moro presented when he was Minister of Justice in the management of Jair Bolsonaro (PL).

PLs 1903/2021 and 1822/2022, for example, rescue the environmental listening authorization without judicial authorization in some cases, including when there is a risk to life, freedom or sexual dignity. In the anti-crime package, the parliamentarians changed the proposal to only allow the use of this type of listening by the defense, never by the prosecution.

Among the projects that are being processed again on the initiative of Moro are PEC 89/2019, which prohibits the granting of pardons for heinous crimes, against the financial system or public administration and money laundering.

There is also what punishes parties for acts of corruption and makes slush funds a crime, which obliges parties to apply integrity standards.

By unfiling the proposals instead of presenting new projects, the senator rescues the stages in which they have already been approved. Some have already had opinions approved by the thematic committees and can go straight to plenary.
