Journalist Glenn Greenwald emerged victorious from a lawsuit filed against him by Senator Sergio Moro (União-PR). The former judge of Operation Lava Jato claimed that publications in which he was called a “corrupt judge” by Glenn were excluded from Twitter and YouTube — and even obtained a favorable decision in the first instance. This week, however, the 8th Civil Chamber of the Court of Justice of Paraná decided that the posts should be preserved.

“The court recognized Glenn’s right to call a corrupt judge a corrupt judge”, says lawyer José Renato Gaziero Cella, responsible for the journalist’s defense. “Public people are subject to criticism. Moro himself is blunt against his critics”, he completes.

During his support in court, lawyer Carolina Padilha, who represents Moro, stated that Glenn committed a direct offense by associating the former judge with a crime he did not commit.

“It is evident that we are far beyond criticism and journalistic reporting based on facts. We are bringing a totally direct accusation, which is the crime of corruption”, said Padilha.

“We are talking about a renowned, serious and nationally known journalist, who certainly knows the concept of corruption and certainly used it with the intention of offending,” he added.

The rapporteur for the action, judge Hélio Henrique Lopes Fernandes Lima, cited the judgment of the ADPF (Arguição de Descumprimento de Preceito Fundamental) 130 by the Federal Supreme Court (STF), which guaranteed full freedom of the press in the country, and said that the exclusion would amount to the censorship.

“The removal of content referring to the aggravated [Moro]then pre-candidate for the Presidency of the Republic, would imply, in my view, in harming the freedom of public and political opinion of the aggravating factor [Glenn]which plays a role in the press, raising evident censorship”, said the magistrate. He was accompanied by the judge reviewer of the case, Gilberto Ferreira.

With the two votes, a majority formed against the lower court decision that had determined Glenn Greenwald to exclude publications critical of Moro. The only contrary vote was presented by the judge Luciano Carrasco Falavinha de Souza.

“Even in the case of a public person, at the time claiming to be a pre-candidate for the Presidency of the Republic, it is not correct to accept, in the name of freedom of expression, gratuitous and unjustified offenses”, said Souza, when defending that Moro was not convicted. for corruption.

The senator can still file appeals with the Court of Paraná or appeal to the STF and the Superior Court of Justice (STJ).

In addition to the request for the exclusion of the posts, the former judge of Operation Lava Jato asked for compensation in the amount of R$ 200,000 for moral damages. The request will still be analyzed in the first instance.

As the decision to exclude the publications was suspended until the action was analyzed by the collegiate body of the court, Glenn did not delete the posts in which he calls Moro a “corrupt judge” – and they are all still on the air.
