The Minister of the Federal Supreme Court (STF) Alexandre de Moraes revoked this Friday (3) the preventive detention of the former Commander General of the Military Police of the Federal District (PM-DF), Colonel Fábio Augusto Vieira. He was arrested on January 10 by order of Moraes, at the request of the Federal Police (PF), who pointed out the connivance and omission of local authorities during the acts of vandalism on January 8.

In the decision, Moraes considered the report by the former Federal Public Security Intervener of the DF, Ricardo Cappelli, which indicates “in principle” that Vieira would not have been directly responsible for the failure of the security actions that resulted in the criminal acts, informed Agência Brasil. . “In addition to pointing out that the investigated person was present in the operation, he was injured in the direct fight against the demonstrators and did not have his requests for reinforcements met,” wrote the minister.

“Consequently, […] the procedural panorama that justified the preventive detention of the investigated person no longer exists at the present time, and it is possible to grant him provisional release”, he added. As a precautionary measure, the Minister prohibited Vieira from leaving the Federal District without notifying the Court.

On Wednesday (1st), the Attorney General’s Office (PGR) defended the maintenance of Vieira’s preventive detention. The PGR considered that “there has been no change in the situation in fact or in law since the decision determining the preventive detention of the applicant, which, therefore, must be maintained”.
